Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of PM3K, including the PM3K dashboard, REST API, related Workers/Functions, and any integrations (for example, via n8n, Make, or other automation tools) (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

2. Description of the Service

PM3K provides a lightweight API-first tool to schedule and send content to TikTok using your own TikTok account. PM3K is not affiliated with, endorsed by, or officially sponsored by TikTok. TikTok is a separate, third-party platform with its own terms and policies.

You connect your TikTok account via OAuth. By doing so, you authorize PM3K to use the permissions granted (scopes) to create and manage posts under your TikTok account strictly for the purposes of this Service.

4. User Responsibilities

You are fully responsible for everything that happens under your PM3K session, your API key, and any automations you configure.

PM3K may automatically detect duplicate videos, unsafe caption patterns, or abnormal posting activity, and may block or cancel such posts or jobs to comply with TikTok anti-spam rules and protect the Service.

6. Content Ownership

You retain all rights to the content you upload, schedule, or send through PM3K. PM3K does not claim ownership of your content.

By using the Service, you grant PM3K a limited, non-exclusive, revocable license to process, store temporarily, and transmit your content solely for the purpose of providing the Service (for example, to create a TikTok post, retry a failed job, or display job status in your dashboard).

You are responsible for ensuring you have all necessary rights and permissions (including from third parties) to use and distribute your content via TikTok and via PM3K.

7. Third-Party Services (TikTok and Others)

PM3K relies on TikTok APIs and other third-party services. Their availability and behavior are outside of PM3K’s control.

PM3K may periodically call TikTok’s creator_info (or equivalent) endpoint for your connected account. We use this response to check whether your account is currently allowed to post through the TikTok posting flow and what posting limits apply. If TikTok reports that your account cannot post (for example, due to account restrictions, temporary limits, or policy violations on TikTok’s side), PM3K will block new posts or scheduled jobs for this account and show an error in the dashboard. PM3K cannot override TikTok’s own limitations and is not responsible if TikTok refuses to accept or publish your content.

PM3K may also refuse to create or run jobs, or may cancel or delay them, if they violate these Terms or trigger our abuse, safety, or anti-spam protections.

8. Plans, Billing, and Limits

PM3K offers a one-time Free start period and paid subscription plans. The current pricing, limits, and plan features are displayed on the PM3K website or dashboard.

9. API Keys, Abuse, and Enforcement

Your API key is personal to your profile and must not be shared publicly or sold to third parties.

PM3K reserves the right, at its sole discretion and without prior notice, to:

PM3K revokes all TikTok OAuth tokens and deletes all API keys on logout (when using the “Sign out fully” option). Your PM3K profile (plan tier and expiration window) is preserved so that your subscription and storage limits are not reset.

10. Service Changes and Termination

PM3K may modify, suspend, or discontinue the Service (in whole or in part) at any time, including by removing features, introducing new limits, or changing technical implementation.

You may stop using the Service at any time by disconnecting TikTok and revoking your API key. PM3K may terminate or suspend your access if you violate these Terms or if required by law or by TikTok policies.

The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, or non-infringement.

Without limiting the foregoing, PM3K does not warrant that:

To the maximum extent permitted by applicable law, PM3K and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service.

To the extent any liability is found despite the above, the total aggregate liability of PM3K arising out of or relating to the Service shall not exceed the amount you paid for the Service in the three (3) months preceding the event giving rise to the claim (if any).

13. Data, Privacy, and Retention

PM3K processes limited personal data and technical data needed to operate the Service, such as TikTok identifiers, job metadata, and basic account information.

Storage of media files (where used) is typically time-limited and subject to automatic deletion after a defined retention period. Exact behavior and retention windows may vary by plan and are described in the documentation or on the dashboard.

PM3K storage is temporary and may delete media automatically after the plan-specific retention period. You are responsible for maintaining your own backups of any media or data you wish to keep.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will adjust the “Last updated” date at the top of this page. In some cases, and where required by law, we may also provide additional notice (for example, via the dashboard).

Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service.
